1. Introduction

These Terms and Conditions ("Terms") govern your use of services provided by TriggerX LLC ("TriggerX," "we," "us," or "our"), a Wyoming-registered company at 30 N Gould St, Ste N, Sheridan, WY 82801.

By engaging our services or accessing triggerx.ai, you agree to be bound by these Terms. If you disagree with any part, you may not use our services. You represent that you are at least 18 years of age. TriggerX does not permit those under 18 to use our services.

2. Services

TriggerX provides done-for-you sales systems and revenue automation services, including but not limited to:

  • Cold email infrastructure setup — domains, mailboxes, warmup, and deliverability configuration

  • Outbound prospecting campaigns via email and LinkedIn

  • Multi-touch lead follow-up sequences

  • CRM configuration, pipeline setup, and performance dashboards

  • AI sales agent installation and chatbot configuration

  • Lead list building, ICP research, and TAM mapping

The specific scope of services for any engagement will be defined in your individual service agreement or onboarding documentation.

3. SMS Messaging Terms

TriggerX LLC offers a text messaging program for prospects and clients who have provided prior express consent to receive SMS communications. By opting in, you agree to receive text messages from TriggerX LLC. Consent to receive SMS messages is not a condition of purchase.

Types of Messages

By opting in, you may receive:

  • Responses to inquiries submitted through our website

  • Follow-up messages related to your request or services

  • Scheduling and coordination messages

  • Conversational messages during the sales process

  • Promotional messages, including special offers, discounts, and service updates (only if separate marketing consent is provided)

Message Frequency

Message frequency varies based on your interaction with us. You will receive up to 10 messages per month. Message frequency may vary depending on your interaction with us. Additional messages may be sent in direct response to your replies.

These messages may include conversational, transactional, and promotional content depending on your consent preferences.

Opt-Out Instructions

You can cancel the SMS service at any time. Just text "STOP" to +1 (917) 718-5687. After you send the SMS message "STOP" to us, we will send you an SMS message to confirm that you have been unsubscribed. After this, you will no longer receive SMS messages from us. If you want to join again, just sign up as you did the first time and we will start sending SMS messages to you again.

If you are experiencing issues with the messaging program you can reply with the keyword HELP for more assistance, or you can get help directly at hello@triggerx.ai.

Message and Data Rates

Message and data rates may apply for any messages sent to you from us and to us from you. If you have any questions about your text plan or data plan, it is best to contact your wireless provider.

Carrier Disclaimer

Carriers are not liable for delayed or undelivered messages.

Platform Disclosure

TriggerX LLC uses GoHighLevel as its customer relationship management (CRM) and communications platform. This system is used to store contact information, manage customer interactions, and send communications including SMS messages, emails, and automated follow-ups as part of our service delivery.

Compliance & Consent

SMS messages are sent only to individuals who have provided prior express consent through our website forms or other approved opt-in methods. Consent is not a condition of purchase, and you may withdraw your consent at any time by following the opt-out instructions above.

4. Subscription and Payment

4.1 Service Period

Services are provided on a month-to-month basis with no minimum commitment unless otherwise specified in your service agreement. Either party may cancel by providing written notice at least 15 days before the end of the current billing period.

4.2 Fees

You agree to pay the monthly fee specified in your service agreement. Fees are due at the start of each billing cycle. Payments are processed via Stripe or another payment processor we designate.

4.3 Refund Policy

Founder's Trial clients receive Month 1 free, with no payment collected until Month 2. All payments made after Month 1 are non-refundable once work for that billing period has commenced.

Standard clients who cancel within 3 business days of payment and before work begins will receive a full refund. After this period, all payments are non-refundable.

4.4 Late Payment

We reserve the right to suspend services if payment is not received within 7 days of the due date. Services resume upon receipt of outstanding payment.

5. Client Responsibilities

You are responsible for providing all information, approvals, and access required for TriggerX to perform its services, including:

  • Accurate information about your business, target market, and ideal customer profile

  • Timely responses to onboarding questionnaires and feedback requests

  • Access to relevant tools, CRM systems, and platforms

  • Compliance with all applicable laws in your use of the systems we build, including CAN-SPAM, TCPA, and any state-level marketing laws

We are not responsible for delays or underperformance caused by your failure to provide required information or approvals.

6. Ownership of Deliverables

All sequences, workflows, automations, lead lists, playbooks, and campaign assets built by TriggerX for your business are owned by you upon delivery. We retain no claim over the work product created specifically for your engagement. Our proprietary methodologies, templates, internal processes, and systems documentation remain the sole property of TriggerX.

7. Confidentiality

Both parties agree to keep confidential any proprietary or sensitive information shared during the engagement, including business strategies, client data, pricing, campaign performance, and the content of the service agreement. This obligation survives termination.

8. Data and Records

You are solely responsible for managing, storing, and backing up data and records related to leads, contacts, and campaigns generated through our services. We do not maintain long-term storage of client data and are not liable for any loss of data following the conclusion of an engagement.

9. No Guarantee of Results

We build and install sales systems based on proven methodologies. However, results depend on factors outside our control, including your market, offer, pricing, competition, and sales process. We do not guarantee specific outcomes including any defined number of leads, meetings, or revenue. We commit to building the system correctly, optimizing based on data, and working with you to improve results.

10. No Warranty

Our services are provided "as is" without warranty of any kind, express or implied. We do not warrant that our services will be uninterrupted, error-free, or that results will meet your specific expectations.

11. Limitation of Liability

To the fullest extent permitted by law, TriggerX will not be liable for any indirect, special, consequential, incidental, or punitive damages arising from your use of our services, including lost revenue, lost profits, or loss of data. Our total liability for any claim arising from these Terms or our services shall not exceed the total fees paid by you in the 3 months preceding the claim.

12. Indemnification

You agree to indemnify and hold TriggerX, its officers, employees, and contractors harmless from any claims, losses, damages, liabilities, or expenses arising from your breach of these Terms, your use of the systems we build, or your violation of any applicable law or third-party right.

13. Termination

Either party may cancel services at any time by providing written notice to hello@triggerx.ai. Cancellation takes effect at the end of the current billing period. No refunds are provided for the month in which cancellation is requested.

14. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Wyoming. Any dispute arising from these Terms or your use of our services shall first be subject to good-faith negotiation for 30 days. If unresolved, disputes shall be finally resolved through binding arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules. The arbitration shall take place in Wyoming.

15. Changes to These Terms

We reserve the right to modify these Terms at any time. We will provide at least 30 days' notice of material changes. Continued use of our services after changes take effect constitutes acceptance of the revised Terms.

Anti-Spam Policy

TriggerX LLC is committed to ethical and legally compliant outreach. This Anti-Spam Policy applies to all outbound campaigns, email sequences, and communication systems we build and operate on behalf of clients.

Our Commitment

TriggerX does not send unsolicited bulk email or engage in any practice that violates the CAN-SPAM Act (US), CASL (Canada), GDPR (EU/UK), or any other applicable anti-spam legislation. All outbound campaigns we build are designed to comply with applicable law in the jurisdictions where they are deployed.

Outbound Email Practices

All cold email campaigns we build include the following as standard:

  • Clear identification of the sender and the business on whose behalf the email is sent

  • A valid physical mailing address in the email footer

  • A functioning and clearly visible opt-out or unsubscribe mechanism in every email

  • Immediate processing of unsubscribe requests — opt-outs are removed from active sequences within 10 business days and are not contacted again

  • Honest, non-deceptive subject lines

  • Targeting of business-to-business contacts only — we do not build or run consumer spam campaigns

SMS Practices

For SMS messages sent through TriggerX's own SMS program, you may opt out at any time by replying STOP to any message you receive. We will send one final confirmation message and no further messages will be sent. SMS communications are governed by our SMS Messaging Terms above. Client Responsibilities

Clients engaging TriggerX for outbound services agree to:

  • Use the systems and contact lists we build only for lawful business purposes

  • Not add contacts to sequences who have previously opted out or unsubscribed

  • Not instruct TriggerX to send deceptive, misleading, or harassing communications

  • Comply with all applicable anti-spam laws in the jurisdictions where their business operates

Data Privacy
TriggerX LLC collects and uses phone numbers, message content, and related metadata solely to deliver SMS services, respond to inquiries, maintain compliance, and improve performance.

SMS opt-in consent and mobile information are not shared with third parties for marketing or promotional purposes. Information may only be shared with service providers necessary to operate the messaging program, wireless carriers for message delivery, or as required by law.

Compliance
This SMS program operates in compliance with applicable laws and regulations, including the TCPA, CAN-SPAM provisions, CTIA guidelines, and A2P 10DLC requirements. Messages are only sent to users who have provided appropriate consent.

We reserve the right to immediately suspend or terminate services for any client found to be using our systems in violation of this policy or applicable law.

Reporting Violations

If you believe you have received unsolicited communication as a result of a TriggerX-built system, contact us at hello@triggerx.ai. We take all complaints seriously and will investigate promptly.
