SMS TERMS OF SERVICE & PRIVACY POLICY

TriggerX LLC ("TriggerX", "we", "us", or "our") provides automated SMS communication systems for service businesses. This policy governs all text messages sent through our platform on behalf of our clients.
1. CONSENT TO RECEIVE SMS MESSAGES
TriggerX builds automated SMS systems for pest control operators and service businesses. When you provide your phone number to a TriggerX client (the pest control company, service provider, or business you contacted), you consent to receive automated text messages from that specific business.
Messages are sent by TriggerX's automation platform on behalf of the client business and may include:
Missed call responses and callback confirmations
Appointment reminders and confirmations
Quote follow-ups and service updates
Review requests after service completion
Occasional service-related announcements
The business you contacted remains responsible for the content and timing of messages. TriggerX provides the technical infrastructure only.
Consent is not required as a condition of purchasing any goods or services. You may opt out at any time without affecting your ability to receive services from the business.
2. HOW CONSENT IS OBTAINED
You provide consent to receive SMS messages when you:
Submit your phone number through a contact form, quote request, or service inquiry
Call a business and your missed call triggers an automated response
Provide your number during booking or scheduling
Reply to an initial message from the business
Check an opt-in box on a form that clearly discloses SMS communications
Express written consent is obtained for all marketing and promotional messages. Transactional messages (appointment reminders, service updates, callback notifications) may be sent based on the business relationship and your provision of a phone number for that purpose.
3. MESSAGE FREQUENCY
Message frequency varies depending on your interaction with the business and the automation system in place.
Typical frequency:
Transactional messages: 1-3 messages per service interaction (appointment confirmation, reminder, follow-up)
Follow-up sequences: Up to 3-5 messages over 7-10 days for quote follow-up or lead nurture
Service updates: Occasional messages as needed for scheduling changes or important updates
You may receive up to 5-8 messages per month from a TriggerX-powered SMS system under normal usage. If you actively engage in a conversation by replying to messages, additional messages may be sent in response to continue the conversation.
You will never receive unsolicited bulk promotional messages without explicit opt-in consent.
4. MESSAGE AND DATA RATES
Standard message and data rates may apply depending on your mobile carrier and plan. TriggerX and its client businesses are not responsible for any charges incurred from your carrier as a result of receiving SMS messages.
Most US mobile plans include unlimited texting, but if you have a limited plan, each message received counts toward your plan's SMS allotment.
5. OPTING OUT (UNSUBSCRIBE)
You may opt out of receiving SMS messages at any time by replying STOP to any message.
What happens when you opt out:
You will be immediately removed from all active SMS sequences
You will receive one final confirmation message acknowledging your opt-out
No further messages will be sent from that business through the TriggerX system
To re-subscribe later: Reply START to the same phone number from which you previously received messages, or contact the business directly to re-enable SMS notifications.
Other opt-out methods:
Contact the business directly and request removal from SMS communications
Email us at privacy@triggerx.ai with your phone number and the business name
Opt-out requests are processed within 24 hours and typically take effect immediately.
6. HELP AND SUPPORT
For assistance with SMS messages:
Reply HELP to any message for automated assistance
Contact the business directly using the phone number or contact details provided in their messages
For technical issues with the SMS system itself, email support@triggerx.ai
For privacy concerns or data deletion requests:

7. SUPPORTED CARRIERS
SMS services operate on all major US mobile carriers including but not limited to:
AT&T
Verizon
T-Mobile
Sprint
US Cellular
Metro PCS
Cricket Wireless
Boost Mobile
Carrier support may vary. TriggerX is not liable for delayed, undelivered, or filtered messages due to carrier network issues, outages, or spam filtering outside of our control.
8. A2P 10DLC COMPLIANCE
All SMS campaigns built and operated by TriggerX are registered and compliant with A2P 10DLC (Application-to-Person 10-Digit Long Code) requirements as mandated by US mobile carriers.
What this means:
Our business and brand are verified with carrier networks
Every SMS campaign is registered with a specific use case
We operate only on approved, registered phone numbers
Messages are sent through compliant infrastructure with proper throughput limits
We do not operate unregistered, gray-route, or non-compliant SMS campaigns. All messaging infrastructure meets or exceeds carrier standards for deliverability, security, and compliance.
9. TCPA COMPLIANCE
TriggerX and its client businesses comply with the Telephone Consumer Protection Act (TCPA) and all applicable federal and state laws governing SMS and automated communications.
Our TCPA compliance practices include:
Express consent: We obtain express written or verbal consent before sending automated text messages for marketing purposes
Transactional exemption: Service-related messages (appointment reminders, confirmations, updates) are sent pursuant to an established business relationship
Immediate opt-out: We honor all STOP requests immediately, typically within seconds, and always within 24 hours
Do Not Call Registry: We do not send marketing messages to numbers on the National Do Not Call Registry without prior express written consent
Time restrictions: Messages are sent only between 8:00 AM and 9:00 PM in the recipient's local time zone unless the message is in response to a customer-initiated inquiry
Record keeping: We maintain records of all consent, opt-in timestamps, and opt-out requests for compliance and audit purposes
If you believe you received a message in violation of TCPA, please contact us immediately at privacy@triggerx.ai so we can investigate and resolve the issue.
10. DATA PRIVACY AND RETENTION
What data we collect:
Phone numbers provided to TriggerX client businesses
Message content sent and received
Timestamps of messages and interactions
Opt-in and opt-out records
Delivery status and carrier information
How we use this data:
To deliver SMS messages on behalf of client businesses
To process opt-out requests and maintain compliance
To improve system performance and deliverability
To generate analytics and reports for client businesses
How we protect this data:
Phone numbers and message logs are stored securely using industry-standard encryption
Data is transmitted over secure, encrypted connections
Access is restricted to authorized personnel only
We implement physical, technical, and administrative safeguards to prevent unauthorized access
How we share (or don't share) this data:
Phone numbers are not sold, rented, or shared with third parties for marketing purposes
Data is shared only with the specific client business you contacted and with service providers necessary to deliver SMS (e.g., carrier networks, SMS infrastructure providers)
We may disclose data if required by law, court order, or government regulation
Data retention:
Phone numbers and message logs are retained only as long as necessary to provide services or as required by law
Opt-out records are retained indefinitely to honor your preferences
You may request deletion of your data at any time by emailing privacy@triggerx.ai

11. PROHIBITED USE
Client businesses may not use TriggerX's SMS systems to send:
Unsolicited bulk messages to individuals who have not provided consent
Fraudulent, deceptive, or misleading content
Harassing, threatening, abusive, or obscene messages
Spam or junk messages
Phishing attempts or requests for sensitive personal information (passwords, SSNs, credit card numbers)
Content that violates any applicable federal, state, or local law or regulation
Messages promoting illegal activities
Content that infringes on intellectual property rights
Violation of this policy will result in:
Immediate suspension or termination of SMS services
Reporting to carrier networks and regulatory authorities as required
Potential legal action
If you receive a message that violates these terms, please report it immediately to report@triggerx.ai with the phone number, message content, and timestamp.
12. LIMITATION OF LIABILITY
To the maximum extent permitted by law:
TriggerX is not liable for any delays, failures, or errors in message delivery caused by carrier networks, device issues, or factors outside our control
We are not responsible for charges imposed by your mobile carrier
We are not liable for the content of messages sent by client businesses, as clients are responsible for their own messaging content and compliance
Our total liability for any claim related to SMS services shall not exceed the fees paid by the client business for SMS services in the preceding 12 months
SMS services are provided "as is" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
13. MODIFICATIONS TO THIS POLICY
We may update this SMS Terms of Service and Privacy Policy from time to time to reflect changes in our practices, technology, legal requirements, or for other operational reasons.
When we make changes:
The updated policy will be posted on this page with a new "Last Updated" date
Material changes may be communicated via email or SMS to active users
Continued use of SMS services after changes are posted constitutes acceptance of the updated terms
We encourage you to review this policy periodically to stay informed about how we handle SMS communications and protect your privacy.

15. GOVERNING LAW
This SMS Terms of Service and Privacy Policy is governed by the laws of the State of Wyoming and the United States of America, without regard to conflict of law principles.
Any disputes arising from this policy or the use of SMS services shall be resolved in the state or federal courts located in Wyoming.
16. SEVERABILITY
If any provision of this policy is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.
SUMMARY OF YOUR RIGHTS
You have the right to:
